1. Scope

These general terms and conditions apply for all services of the Eagle GSC when you use any of the service provided by Eagle GSC that you find on:


2. Subject of service

Subject of service is the management of Internet accounts (wallet) and the issue of MasterCard credit cards (since 01 Jan 2018). Use of the account is via the website and your mobile device.

The checking account contract includes the following services:

  • Account management
  • Payment transactions
  • Standing orders
  • MasterCard

The account serves the management of payment transactions and credit card transactions on the associated MasterCard. The credit balance of the account is due daily and does not receive any interest. The account is run on a current account basis and is a credit account. Furthermore, depending on your credit rating, you can also conclude a bank overdraft contract with us.


3. Opening an account

Because an Internet account is a regulated financial services product, we are required by law to store certain information about you. We use this information to manage your account and in case of a theft or loss it serves to identify you and your account. We store this information only as long as it is necessary and only for the above-mentioned purposes.

In order to get an Internet account you need to be at least 18 years of age, unless you receive other information from us exempting you from this rule. We require proof of your identity (passport only) and of your address. As proof, we may require documentary evidence from you and/or we run electronic checks on you.

When we carry out these checks, your personal information might be passed on to credit report agencies and institutions for fraud prevention. These bodies may store this information and the search may leave a trace in your credit file, although it will be evident that the investigation was not a credit review and not carried out for the purposes of a loan application It serves as an identity verification only and has no adverse impact on your credit rating.

With the acceptance of these general terms and conditions, you show us that you agree to the implementation of the checks described in this document.

If allowed, you may ask for additional cards associated with your account. You give us the permission to issue additional cards and card PINs to additional cardholder and you grant each additional cardholder the permission to authorize transactions in your name. You remain fully responsible, at any time, for any fees or transactions related to the product or any additional card or the use or abuse of each product resp. any additional card you requested.

The customer may only act in his/her own name, on his/her own account, and in his/her interest, without third party initiative.

This Agreement shall also apply to any additional card you ordered. You are obliged under this agreement to pass on this information to any additional cardholder before his/her use of any additional card.

Any information you provide during the ordering process for a product or at any time thereafter must be accurate and truthful. You need to make certain that the information you provide to us or that is otherwise registered in your account is always accurate and up to date. We are not liable for any damage incurred in case you do not do this. We reserve the right, at any time, to request from you the verification of the accuracy of your data or the provision of other evidence confirming the accuracy of the information you provided.

When you submit an Internet account application to Eagle GSC you submit a binding offer to enter a contract concerning the provision of an account with the described functions.

4. Revocation Instructions

Right of revocation

You can revoke your contract declaration within 14 days in text format (e.g. email) without providing reasons. This time period begins with the receipt of these instructions on a durable data carrier, however, not before conclusion of the contract and not before the fulfillment of our information obligation. In order to safeguard the withdrawal period the timely dispatch of your revocation suffices. The revocation should be addressed to:

Revocation consequences

In the case of an effective cancellation, any services received by both parties are to be returned and any benefits (e.g. interest) remitted. In case of an overdraft of your account balance, we are not entitled to either ask you for costs or interest on the repayment of the overdraft amount if we have not provided you with the required information regarding the conditions and consequences of an overdraft (e.g. applicable debit interest rate, costs). You are obliged to pay compensation for any services provided up to the revocation, if you were informed about this legal consequence before you submitted your contract declaration and explicitly agreed to us starting with the provision of services before the end of the revocation period. If there is an obligation for compensation payment, it can lead to the consequence that you are obliged to fulfill the contractual payment obligations for the time period until the revocation. Your right of revocation expires prematurely if the contract has been fulfilled in its entirety by both sides at your explicit request, before you exercised your revocation rights. Obligations for the reimbursement of payments must be satisfied within a period of 30 days. The time period begins for you with the dispatch of your revocation notice, for us with its receipt.

Specific instructions

In the event of revocation of this contract, you are also no longer bound to a contract related with this contract, if the related contract concerns a service performed by us or a third party on the basis of an agreement between us and the third party.




5. Contract language and communication

Contract and communication language is English.

Notifications and statements concerning you contractual relationship with us on the basis of these Terms and Conditions or related to these, should be directed, as long as not stated otherwise in these Terms and Conditions, to:


6. Use of account

Login data are the unique combination of an email address and a password created by yourself when you open your account. With this, you can login via the customer interfaces.

Payment transfers and direct debits can only be carried out via the interface. The fees for bank transfers apply.

Eagle GSC Savings account

You have the possibility to open a Savings account with a credit balance repayable on demand. The interest is credited on a daily basis at every first day of the month. The respective interest rate is variable and can be seen on the interface resp. you are informed about any change after account opening.

Eagle GSC Fixed deposit account

A Fixed deposit account is a product with a fixed 12 months period. The tender is fixed and will be stated at contract conclusion. The interest is credited to the electronic account on a daily basis at every first day of the month. Upon cancellation of the product, the deposit minus any already paid interest is refunded to the Internet account within 14 days.


7. Costs and payments

Charges for our services and any expenses due for you can be found in our price list. See price list

If fees are due, we charge them on a quarterly basis and subtract them at the end of each quarter from your Internet account unless you were expressly informed otherwise or it is stated in the price list. For overdrafts on your account balance, we charge 12% interest per year on the overdraft amount drawn, unless a separate bank overdraft contract has been agreed between you and us.


8. Overdraft of your account and consequences

Payment transactions are only permissible within the actual balance on the account. Initiated payment transactions exceeding the actual account balance are rejected.

Interest on account overdrafts

If you exceed your account balance we charge 12% interest per year on the overdraft amount drawn. If you did not conclude a separate bank overdraft contract with us, the current interest rates of the overdraft credit contract are valid on all overdrafts on your account up to the amount of your overdraft limit.

The bank will inform the customer at regular intervals about adjusted account overdraft interest rates and - where they exist - about the adjusted amount and due date of the interest payments, provided that they change. You will be informed in your account statement about adjustments of the account overdraft interest rate.

Factors such as changes of the credit default risk of the customer, credit rating of the Bank as well as in-house cost calculations are not taken into account for the adjustment of the account overdraft interest rate.

The interest is due in arrears at the end of a calendar month and charged to the account.

8. Notification and disclosure obligations

You're obligated to provide us with accurate information about your personal data, in particular your name, your address, your date of birth, your phone number, and your e-mail address, and to notify us promptly of any changes.

9. Blocking of the account and the card

If we have justified reasons to assume that unauthorized use of your account is taking place, we can block or limit access to it. Is this the case, we will inform you immediately via email and/or text message. Likewise, we will block your account if you inform us of any such activities. We will lift the block or restriction, if the reasons for it no longer exist.

Blocking of the card

You always have the possibility to block and unblock your card independently via the customer interfaces. You can register your card as stolen. This leads to a permanent blocking of your card and the dispatch of a new one. You also have the possibility to call our Customer Support to have your card blocked by one of our staff after successful verification of your identity.

10. Data protection and banking secrecy

The collection, processing, and use of your personal data are carried out under strict compliance with the applicable data protection rules and in keeping with the rules of the banking secrecy.

11. Duration of contract; Cancellation

Your contract with us runs for an indefinite period. It ends automatically at the end of your contract regarding your current account managed via the online interface offered by us, unless otherwise agreed. With the end of our contractual relationship with you, all user rights granted to you in accordance with these supplementary provisions also end.

End user right of cancellation

As far as there is no agreement about a determined time period, the company and the customer can cancel the entire business relationship or individual parts of it (also credit agreements and framework agreements for payment services such as in particular electronic account contracts) at any time without keeping of a particular time limit.

Prepaid charges are not refunded.

Cancellation for an important reason

In the presence of an important reason, the company and the customer can cancel the entire business relationship or individual parts of it despite an existing agreement over a fixed period at any time with immediate effect.

An important reason allowing cancellation by the company exists in particular, if

-             a deterioration or threat to the financial circumstances of the customer or a co-responsible person occur and thus pose a risk to the fulfillment of obligations towards the company

-             the customer supplies inaccurate information about his financial circumstances or any other significant circumstances

-             the customer is involved in punishable offences or carries out/tries to carry out punishable offences with the services or the company

Legal consequences

At the end of the entire business relationship or individual parts thereof, any amounts still owed become due immediately. The customer is also liable to free the company from all commitments undertaken for him/her.

Moreover, the company is entitled to cancel all commitments undertaken for the customer. These Terms and Conditions also apply after the end of the business relationship until all business is closed.


Right to refuse payment

The company has the right to refuse payment of the balance for objectively justified reasons, if there is suspicion of a punishable offence or money laundering. In this case it is up to the customer to provide objective evidence.

12. Offset

Against our claims, you can only set off with undisputed or legally determined counter-claims.

13. Modification of these Terms and Conditions

You shall be notified of changes of these Terms and Conditions and the special terms at least two months before their proposed effective date via e-mail. Your consent shall be deemed to be given if you do not notify us of your rejection before the proposed effective date of the changes. We will specifically notify you of this de facto consent in our offer. If you do not agree with the changes, you can cancel your contract up to the effective date of the changes without further notice. We will specifically notify you of this cancellation right in our offer.

14. Applicable law

For the business relationship between you and Eagle GSC, British laws are applicable.


15. Further notices

For these supplementary provisions, German law under exclusion of international private law shall apply. In business transactions with consumers within the European Union, the law of the place of residence of the consumer can be applicable provided mandatory consumer protection provisions are involved.
